  IMO поддержала принятие Конвенции ООН о продаже судов в судебном порядке

  IMO призывает государства-члены ратифицировать соглашение. Россия документ не подписала

  Международная морская организация (IMO) приветствовала подписание Конвенции ООН о международных последствиях продажи судов в судебном порядке. Церемония подписания конвенции состоялось 5 сентября 2023 года в Пекине (КНР), говорится в пресс-релизе IMO.

  «Пекинская конвенция о продаже судов в судебном порядке» была разработана Комиссией ООН по праву международной торговли (UNCITRAL) для решения проблемы, с которой сталкиваются добросовестные новые судовладельцы и те, кто финансирует покупку судов. Новые владельцы и финансовые организации вынуждены были решать споры с предыдущими кредиторами, предъявляющими требования на судно в качестве обеспечения кредита.

  Пекинская конвенция устанавливает согласованный и упрощенный режим, который обеспечивает трансграничное признание продажи судов в судебном порядке, обеспечивая бесперебойное функционирование международной торговли. Для облегчения действия режима признания и защиты прав сторон, заинтересованных в судне, уведомление о продаже в судебном порядке и сертификат о продаже в судебном порядке должны быть выданы в государстве, в котором осуществляется сделка.

  IMO поддерживает разработку Конвенции, выступая в качестве единой информационной базы, содержащей все уведомления и юридические документы о продаже в судебном порядке. Информация о предстоящих и завершенных сделках о продаже судов в судебном порядке будет доступна в Интернете через специальный модуль на платформе «Глобальной интегрированной информационной системы судоходства» (GISIS) IMO.

  В связи с принятием Конвенции о международных последствиях продажи судов в судебном порядке, IMO призывает свои государства-члены ратифицировать соглашение.

  Статья 21 Конвенции предусматривает, что она вступит в силу через 180 дней после даты передачи на хранение третьего документа о ратификации, принятии, одобрении или присоединении.

  На настоящий момент Конвенцию подписали 15 стран: Китайская Народная Республика, Буркина-Фасо, Гондурас, Гренада, Кирибати, Коморские Острова, Либерия, Сан-Томе и Принсипи, Сальвадор, Саудовская Аравия, Сенегал, Сьерра-Леоне, Сингапур, Швейцария, и Сирийская Арабская Республика.
